Professor Janicke comes to this task from long experience with the subject. Prior to joining the law faculty of the University of Houston in 1992, he was a senior partner in Arnold, White & Durkee, where his practice centered on litigation of large-scale patent cases. This new casebook concentrates on patent claims as determinants of coverage and lays out the subject in terms of the power of patent litigation, beginning with analysis of the reach of the various remedies available for patent infringement, including injunctive and contempt remedies. A chapter on remedies of the accused infringer follows next, dealing primarily with declaratory relief, attorneys fees, and indemnity. Other chapters include jurisdictional and venue issues in patent cases, the various kinds of estoppels that may be operative, details of affirmative defenses, and the impact of a particular judgment on later proceedings involving the same patent.
